Appendix C Group U—Agricultural Buildings

AMENDMENT
This section has been amended at the state or city level.
(Adopted by the State of Oregon as part of the Oregon Structural Specialty Code.)

The provisions contained in this appendix are not mandatory unless specifically referenced in the adopting ordinance.

C101.1 Scope

AMENDMENT
This section has been amended at the state or city level.
Agricultural buildings and equine facilities meeting the parameters of ORS 455.315(1) and (2) are exempt from this code, including submission of plans and permits.

     Unless otherwise exempted by ORS 455.315(1) and (2),
the provisions of this appendix shall apply exclusively to agricultural buildings. Such buildings shall be classified as Group U and shall include the following uses:
  1. Livestock shelters or buildings, including shade structures and milking barns.
  2. Poultry buildings or shelters.
  3. Barns.
  4. Storage of equipment and machinery used exclusively in agriculture.
  5. Horticultural structures, including detached production greenhouses and crop protection shelters.
  6. Sheds.
  7. Grain silos.
  8. Stables.
ORS 455.315(1) and (2) are not a part of this code but are reproduced here for the reader's convenience:

455.315 Exemption of agricultural buildings, agricultural grading and equine facilities.
  1. The provisions of this chapter do not authorize the application of a state structural specialty code to any agricultural building, agricultural grading or equine facility.
  2. As used in this section:
    1. "Agricultural building" means a structure located on a farm or forest operation and used for:
      1. Storage, maintenance or repair of farm or forestry machinery and equipment;
      2. The raising, harvesting and selling of crops or forest products;
      3. The feeding, breeding, management and sale of, or the produce of, livestock, poultry, furbearing animals or honeybees;
      4. Dairying and the sale of dairy products; or
      5. Any other agricultural, forestry or horticultural use or animal husbandry, or any combination thereof, including the preparation and storage of the produce raised on the farm for human use and animal use, the preparation and storage of forest products and the disposal, by marketing or otherwise, of farm produce or forest products.
    2. "Agricultural building" does not mean:
      1. A dwelling;
      2. A structure used for a purpose other than growing plants in which 10 or more persons are present at any one time;
      3. A structure regulated by the State Fire Marshal pursuant to ORS chapter 476;
      4. A structure used by the public; or
      5. A structure subject to sections 4001 to 4127, title 42, United States Code (the National Flood Insurance Act of 1968) as amended, and regulations promulgated thereunder.
    3. "Agricultural grading" means grading related to a farming practice as defined in ORS 30.930.
    4. "Equine facility" means a building located on a farm and used by the farm owner or the public for:
      1. Stabling or training equines; or
      2. Riding lessons and training clinics.
    5. "Equine facility" does not mean:
      1. A dwelling;
      2. A structure in which more than 10 persons are present at any one time;
      3. A structure regulated by the State Fire Marshal pursuant to ORS chapter 476; or
      4. A structure subject to sections 4001 to 4127, title 42, United States Code (the National Flood Insurance Act of 1968) as amended, and regulations promulgated thereunder. [Formerly 456.758 and then 456.917; 1995 c.783 §1; 2003 c.74 §1; 2005 c.288 §3; 2013 c.73 §3]
Buildings classified as Group U Agricultural shall not exceed the area or height limits specified in Table C102.1.

The area of a one-story Group U agricultural building shall not be limited if the building is surrounded and adjoined by public ways or yards not less than 60 feet (18 288 mm) in width.
The area of a two-story Group U agricultural building shall not be limited if the building is surrounded and adjoined by public ways or yards not less than 60 feet (18 288 mm) in width and is provided with an approved automatic sprinkler system throughout in accordance with Section 903.3.1.1.
Mixed occupancies shall be protected in accordance with Section 508.
Exits shall be provided in accordance with Chapters 10 and 11.
Exceptions:
  1. The maximum travel distance from any point in the building to an approved exit shall not exceed 300 feet (91 440 mm).
  2. One exit is required for each 15,000 square feet (1393.5 m2) of area or fraction thereof.
