[NY] AE101.1 General

AMENDMENT
This section has been amended at the state or city level.
These provisions shall be applicable only to a manufactured home used as a single dwelling unit and shall apply to the following:
  1. Construction, alteration and repair of any foundation system that is necessary to provide for the installation of a manufactured home unit.
  2. Construction, installation, addition, alteration, repair or maintenance of the building service equipment that is necessary for connecting manufactured homes to water, fuel, or power supplies and sewage systems.
  3. Alterations, additions or repairs to existing manufactured homes. The construction, alteration, moving, demolition, repair and use of accessory buildings and structures, and their building service equipment, shall comply with the requirements of this code.
These provisions shall not be applicable to the design and construction of manufactured homes and shall not be deemed to authorize either modifications or additions to manufactured homes where otherwise prohibited. The design and construction criteria of Manufactured Homes shall be in accordance with those defined in the Manufactured Home Construction and Safety Standards (24 CFR 3280).

[NY] Section AE102 Application to Existing Manufactured Homes and Building Service Equipment

[NY] AE102.1 General

AMENDMENT
This section has been amended at the state or city level.
Manufactured homes and their building service equipment to which additions, alterations or repairs are made shall comply with all the requirements of these provisions for new facilities, except as specifically provided in this section. Any addition, alteration, or repair made to an existing manufactured home shall not create a hazard to life, health, or safety.

[NY] AE102.2 Additions

Additions made to a manufactured home shall conform to one of the following:
  1. Be certified under the National Manufactured Housing Construction and Safety Standards Act of 1974 (42 U.S.C. Section 5401, et seq.).
  2. Be designed and constructed to comply with the applicable provisions of the National Manufactured Housing Construction and Safety Standards Act of 1974 (42 U.S.C. Section 5401, et seq.).
  3. Be designed and constructed in compliance with the code adopted by this jurisdiction.

[NY] AE102.2.1 Structural Separation

Building additions and accessory structures shall not be structurally supported by the manufactured home.
Exception: Building additions and accessory structures supported by a manufactured home shall be in accordance with designs provided by the home manufacturer or with designs prepared by a registered design professional in accordance with acceptable engineering practice.

[NY] AE102.3 Alterations and Repairs

Alterations or repairs may be made to any manufactured home or to its building service equipment without requiring the existing manufactured home or its building service equipment to comply with all the requirements of these provisions, provided that the alteration or repair conforms to Appendix J of this code.

[NY] AE102.3.1 Materials

AMENDMENT

Alterations or repairs to an existing manufactured home, which are nonstructural and do not adversely affect any structural member or any part of the building or structure having required fire protection, shall be made with materials equivalent to those of which the manufactured home structure is constructed, subject to approval by the building official.
Exception: The installation or replacement of glass shall be in conformance with the fenestration rating requirements for new installations.

[NY] AE102.4 Existing Installations

AMENDMENT

Building service equipment lawfully in existence at the time of the adoption of this code shall have their use, maintenance or repair continued if the use, maintenance or repair is in accordance with the original design and hazard to life, health or property has not been created by such building service equipment.

[NY] AE102.5 Existing Occupancy

Manufactured homes that are in existence at the time of the adoption of these provisions shall have their existing use or occupancy continued if such use or occupancy was legal at the time of the adoption of these provisions, provided that such continued use is not dangerous to life, health and safety.

The use or occupancy of any existing manufactured home shall not be changed unless change in use or occupancy is made to conform to all applicable provisions of this code. Upon any change in use or occupancy, the manufactured home shall cease to be classified as such within the intent of these provisions.

[NY] AE102.6 Maintenance

Manufactured homes and their building service equipment, existing and new, and all parts thereof, shall be maintained in a safe and sanitary condition. Devices or safeguards that are required by applicable codes or by the Manufactured Home Standards shall be maintained in conformance to the code or standard under which it was installed. The owner or the owner's designated agent shall be responsible for the maintenance of manufactured homes, accessory buildings, structures and their building service equipment. To determine compliance with this section, the building official may cause any manufactured home, accessory building or structure to be reinspected.

[NY] AE102.7 Relocation

AMENDMENT

Manufactured homes that are to be relocated shall have a manufacturer's label certifying compliance with applicable Department of Housing and Urban Development (HUD) Manufactured Home Construction and Safety Standards and a data plate affixed in the manufacturing facility bearing not less than the following information:
  1. The statement: "This manufactured home is designed to comply with the federal mobile home construction and safety standards in force at the time of manufacture."
  2. Reference to the structural zone and wind zone for which the home is designed.
  3. Data relative to the heating and insulation zone and outdoor design temperature.
    Exception: Mobile homes manufactured before June 15, 1976, need not comply with these provisions provided that they have been inspected by an agency or individual acceptable to the building official to determine that they are:
    1. Structurally sound.
    2. Free of heating and electrical system hazards.
Written documentation signed by the agency or individual performing the inspection shall be submitted to the building official.

[NY] AE103.1 Permit Required

AMENDMENT

A permit shall be obtained to install, alter, remodel, repair or add accessory buildings or structures to a manufactured home as required in Section R105.2 of this code.

[NY] AE103.2 Application for Permit

To obtain a permit for the work described in Section AE103.1, the applicant shall first file an application, in writing, on a form furnished by the authority having jurisdiction and in accordance with Section R105.2.2 of this code. Such application shall include the identity of the person or entity certified pursuant to Part 1210 (Manufactured Housing) of the New York State Department of State Manufactured Home Regulations (19 NYCRR Part 1210).

[NY] AE103.3 Inspections

All work subject to the permit shall be inspected in accordance with Section R105.3 of this code. Inspections shall include, and not be limited to, the foundation, support, anchorage, connection of multi-sectional homes, and building service equipment.

[NY] AE201.1 General

AMENDMENT

For the purpose of these provisions, certain abbreviations, terms, phrases, words and their derivatives shall be construed as defined or specified herein.

ACCESSORY BUILDING. Any building or structure, or portion thereto, located on the same property as a manufactured home, which does not qualify as a manufactured home as defined herein.

BUILDING SERVICE EQUIPMENT. Refers to the plumbing, mechanical and electrical equipment, including piping, wiring, fixtures and other accessories that provide sanitation, lighting, heating, ventilation, cooling, fire protection and facilities essential for the habitable occupancy of a manufactured home or accessory building or structure for its designated use and occupancy.

DESIGN APPROVAL PRIMARY INSPECTION AGENCY (DAPIA). Refers to any state agency or other private organization that has been accepted by the Secretary of HUD, in accordance with the requirements the Manufactured Home Standards, to evaluate and approve manufactured home design, quality control procedures, and installation manuals.

HUD. The United States Department of Housing and Urban Development.

INSTALLATION INSTRUCTIONS. Means DAPIA approved instructions provided by the home manufacturer that accompany each manufactured home and detail the home manufacturer requirements for support and anchoring systems and other work completed at the installation site.

MANUFACTURED HOME INSTALLATION (AND SETTING). Construction that is required for the installation of a manufactured home, including the construction of the foundation system, required structural connections thereto and the installation of on-site water, gas, electrical and sewer systems and connections thereto that are necessary for the normal operation of the manufactured home.

MANUFACTURED HOME STANDARDS. The Manufactured Home Construction and Safety Standards as promulgated by the HUD.

MANUFACTURER'S CERTIFICATION LABEL. The permanent label that is required by the Manufactured Home Standards to be affixed to each transportable section of each manufactured home.

MOBILE HOME. A moveable or portable dwelling unit that was built prior to June 15, 1976, and designed and constructed to be towed on its own chassis, composed of frame and wheels, connected to utilities, and designed and constructed without a permanent foundation for year-round living, excluding travel trailers. For the purpose of these provisions, a mobile home shall be considered a manufactured home.

A manufactured home shall be limited in use to a single dwelling unit.

[NY] AE301.2 Accessory Buildings

Accessory buildings shall be classified as to occupancy by the building official as set forth in this code.

Manufactured homes and accessory buildings shall be located on the property in accordance with Section R302.1 of this code or any other law or regulation regarding separation distances, whichever is more restrictive.

[NY] AE401.1 New Manufactured Homes

AMENDMENT
This section has been amended at the state or city level.
New manufactured homes shall be installed on a foundation system in accordance with the installation instructions provided by the manufacturer.
Exception: When a foundation or anchoring system is provided that is an alternative to that which is provided in the installation instructions, the alternative shall be in accordance with Section AE402.4.

[NY] AE401.2 Relocated Manufactured Homes

AMENDMENT

Relocated Manufactured Homes shall be installed on a foundation system constructed in accordance with the installation instructions provided by the manufacturer. Where the installation instructions are not available, foundation and anchorage systems which are constructed in accordance with the provisions of 24 CFR 3285 "Model Manufactured Home Installation Standards" or provisions of NFPA 225 shall be deemed to meet the requirements of this code.

[NY] AE401.3 Installation Instructions

The installation instructions and any amendments or addendums as provided by the manufacturer of the manufactured home shall be used to determine permissible points of support for vertical loads and points of attachment for anchorage systems used to resist horizontal and uplift forces, completion and assembly of all systems necessary to make the manufactured home habitable, and attachment or completion of any special or optional features of the manufactured home. When an existing manufactured home is relocated and where installation instructions are not available, foundation and anchorage systems that are constructed in accordance with the provisions of 24 CFR 3285 "Model Manufactured Home Installation Standards" or provisions of NFPA 225 shall be deemed to meet the requirements of this code.

[NY] Section AE402 Foundation Systems

[NY] AE402.1 General

AMENDMENT
This section has been amended at the state or city level.
Foundation systems designed and constructed in accordance with this section shall be considered a permanent installation.

[NY] AE402.2 Soil Classification

AMENDMENT
This section has been amended at the state or city level.
The classification of the soil at each manufactured home site shall be determined in accordance with the requirements of Section R401 of this code.
Exception: When soil classification has been determined in accordance with the installation instructions provided by the manufacturer, such classification shall be deemed to meet the requirements of this code.

[NY] AE402.3 Footings and Foundations

AMENDMENT
This section has been amended at the state or city level.
Footings and foundations shall be constructed of materials specified by this code for the intended use and in all cases shall extend below the frost line, as specified in Table R301.2(1). Footings of concrete and masonry shall be of solid material.
Exception: Where a foundation system is designed by a registered design professional in accordance with the design requirements of the Manufactured Home Standards and the provisions of this code such that it will otherwise be protected from the effects of frost, such foundation system shall not be required to extend below the frost line.

Piers and bearing walls shall be supported on masonry or concrete foundations or piles, or other systems identified in the installation instructions included in the consumer manual(s) provided by the manufacturer, or other alternative foundation systems of sufficient capacity to support all loads and designed by a licensed design professional.

All cast-in-place concrete shall have a specified minimum compressive strength of 3,000 psi (20,684 kPa) at 28 days.

[NY] AE402.4 Alternative Foundation and/or Anchoring System Design

Where a design is provided that is an alternative to the installation instructions provided by the manufacturer, the foundation system shall be designed in accordance with the applicable structural provisions of this code and shall be designed to minimize differential settlement. Where a design is not provided, the minimum foundation requirements shall be as set forth in this code.

Any alternative foundation shall be designed and constructed to conform to the applicable provisions of the "Model Manufactured Home Installation Standards" (24 CFR 3285).

[NY] AE402.5 Drainage

AMENDMENT

The site shall be graded to prevent surface drainage from accumulating under the home in accordance with the requirements of Section R401.3 of this code.
Exception: When site grading has been determined in accordance with the installation instructions provided by the manufacturer, such grading shall be deemed to meet the requirements of this code.

[NY] AE402.6 Under-Floor Clearances—Ventilation and Access

AMENDMENT

A minimum clearance of 12 inches (305 mm) shall be maintained beneath the lowest member of the main frame (Ibeam or channel beam) and the finish grade under all areas of the home. Under-floor spaces between the lowest member of the main frame and the finish grade under all areas of the home shall have a 6-mil polyethylene ground vapor barrier placed on the ground surface covering the entire area under the home. Under-floor spaces shall be ventilated; the minimum net area of ventilation opening shall be not less than 1 square foot (0.0929 m2) for each 1,500 square feet (140 m2) of under-floor space area. One ventilation opening shall be within 3 feet (914 mm) of each corner of the home. Dryer vents and combustion air inlets must pass through the skirting to the outside. Water discharge from furnace, air conditioning, and water heater drains must pass through the skirting to the outside and be directed away from the under-floor space.

Under-floor access openings shall be provided. Such openings shall be not less than 18 inches (457 mm) in width by 24 inches (610 mm) in height and not less than 3 square feet (0.279 m2) in area, and shall be located so that any water supply and sewer drain connections located under the manufactured home are accessible.

[NY] Section AE403 Skirting and Perimeter Enclosures

[NY] AE403.1 Skirting and Permanent Perimeter Enclosures

AMENDMENT
This section has been amended at the state or city level.
Skirting and permanent perimeter enclosures shall be installed only where specifically required by other laws or ordinances. Skirting, when installed, shall provide for the required ventilation and access, shall be of material suitable for exterior exposure and contact with the ground. Permanent perimeter enclosures shall be constructed of materials as required by this code for regular foundation construction.

Skirting shall be installed in accordance with the skirting manufacturer's installation instructions included in the consumer manual(s) provided by the manufacturer or referenced standards. Skirting shall be adequately secured to ensure stability, minimize vibration and susceptibility to wind damage, and compensate for possible frost heave.

[NY] AE403.2 Retaining Walls

AMENDMENT

Where retaining walls are used as a permanent perimeter enclosure, they shall resist the lateral displacements of soil or other materials and shall conform to this code as specified for foundation walls. Retaining walls and foundation walls shall be constructed of approved treated wood, concrete, masonry or other approved materials or combination of materials as for foundations as specified in this code. Siding materials shall extend below the top of the exterior of the retaining or foundation wall, or the joint between the siding and enclosure wall shall be flashed in accordance with this code.
