3304.3.2 Notification of Adjacent Building Owners

When an excavation to a depth of 5 to 10 feet (1524 mm to 3048 mm) is to be made within 10 feet (3048 mm) of an adjacent building, or when any excavation over 10 feet (3048 mm) is to be made anywhere on the site, the person causing an excavation to be made shall provide written notice to the owners of the adjacent building or buildings not less than 10 days prior to the scheduled starting date of the excavation. The written notice shall provide a description of the work to be performed, the time frame and schedule, and contact information of the person causing the excavation and of the department. Foundation or earthwork that is to be done with the use of explosives shall also be subject to the notification requirements set forth in Sections 3307.5.3 and 3307.5.4 of the New York City Fire Code.
