3406.5.15 Cargo Tank and Tank Car

Cargo tanks and tank cars shall be certified and permitted in accordance with this section.
Certification shall be maintained for cargo tanks and tank cars in accordance with the regulations of the United States Department of Transportation, as set forth in Parts 100-180.
It shall be unlawful for any person to load a cargo tank with any flammable liquid or Class II or IIIA combustible liquid or to receive or accept delivery of such products in or from a cargo tank, except in or from a cargo tank for which a department permit has been issued and is displayed pursuant to the provisions of FC Chapter 27. The provisions of this section shall not prohibit the loading of a cargo tank with any liquid products with a flash point over 200°F (93°C) nor the receiving or acceptance of delivery from a cargo tank of any liquid products with a flash point over 200°F (93°C), provided that such cargo tank is designed, constructed, and equipped in accordance with the regulations of the United States Department of Transportation governing the transportation of dangerous articles by common, contract, private and proprietary carriers engaged in interstate commerce.
